These Terms and Conditions govern your use of the Probate Direct service operated by PROBATE DIRECT (NI) LIMITED (Company number NI732711), a company registered in Northern Ireland. By accessing or using our service, you agree to be bound by these terms.

Our service is designed to assist executors in preparing probate application documentation for estates in Northern Ireland. We provide document preparation services only and do not provide legal advice.

2. Service Description

Probate Direct provides an online platform that guides users through the process of preparing probate application documents for submission to the Probate Division of the High Court of Northern Ireland. Our service includes:

  • Generation of NIPF7 (Northern Ireland Probate Form 7)
  • Estate valuation spreadsheet
  • Guidance on the probate application process
  • Instructions for submitting documents to the Court Probate Portal

Important: We do not submit applications on your behalf. You remain responsible for reviewing all generated documents for accuracy and submitting them to the appropriate authorities.

4. User Responsibilities

As a user of Probate Direct, you are responsible for:

  • Providing accurate and complete information about the deceased and their estate
  • Verifying all asset and liability valuations as of the date of death
  • Reviewing all generated documents for accuracy before submission
  • Ensuring you have the legal authority to act as executor or administrator
  • Complying with all applicable laws and regulations in Northern Ireland
  • Submitting completed documents to the Probate Division of the High Court
  • Maintaining confidentiality of your account credentials

You acknowledge that any errors or omissions in the information you provide may affect the accuracy of the generated documents and could result in delays or rejection of your probate application.

5. Service Limitations

Our service is designed for straightforward probate applications in Northern Ireland. We cannot assist with:

  • Contested wills or disputed estates
  • Complex tax planning or inheritance tax advice
  • Estates with significant foreign assets
  • Estates involving trusts or complex business interests
  • Applications outside of Northern Ireland jurisdiction
  • Legal representation in court proceedings

If your estate falls into any of these categories, we recommend seeking advice from a qualified probate solicitor before proceeding.

6. Payment and Refunds

Our service fee of £395 is payable upon completion of your application and before document generation. This fee covers:

  • Preparation of all required probate documents
  • Estate valuation calculations
  • Guidance materials and instructions
  • Email delivery of completed documents

While we use automated systems to generate documents based on the information you provide, we do not verify the accuracy of the information you submit. You are solely responsible for ensuring that:

  • All asset valuations are accurate as of the date of death
  • All liabilities and debts are properly disclosed
  • Personal information about the deceased and beneficiaries is correct
  • You have identified all assets and liabilities of the estate

Providing false or misleading information to the court may result in legal consequences. We strongly recommend obtaining professional valuations for property, businesses, and other significant assets.

8. Limitation of Liability

To the fullest extent permitted by law, PROBATE DIRECT (NI) LIMITED shall not be liable for:

  • Any errors or omissions in the information you provide
  • Delays or rejection of your probate application by the court
  • Any tax liabilities or penalties arising from incorrect information
  • Loss of data due to technical failures (though we maintain regular backups)
  • Any indirect, consequential, or punitive damages

Our total liability to you for any claims arising from our service shall not exceed the amount you paid for the service (£395).

9. Intellectual Property

All content, software, and materials provided through Probate Direct, including but not limited to text, graphics, logos, and software, are the property of PROBATE DIRECT (NI) LIMITED and are protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive license to use our service for the purpose of preparing your probate application. You may not reproduce, distribute, or create derivative works from our materials without written permission.

10. Termination

We reserve the right to suspend or terminate your access to our service at any time if we believe you have violated these Terms and Conditions or engaged in fraudulent or unlawful activity.

You may terminate your use of our service at any time. If you have not yet paid for document generation, no refund is necessary. If you have paid, our refund policy (Section 6) applies.

11. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Northern Ireland. Any disputes arising from these terms or your use of our service shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.

12. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our service or legal requirements. We will notify users of any material changes by email or through a prominent notice on our website.

Your continued use of our service after such changes constitutes your acceptance of the updated terms.
